The Select Committee of the Administrative Council of the EPO has adopted the “True Top 4” proposal for unitary patent renewal fees. As previously discussed here, this proposal reflects the combined sum of renewal fees currently payable in the four Member States in which European patents are most commonly validated (being Germany, France, the UK and the Netherlands). The Committee has stated that they feel this strikes a ‘positive balance’ between ensuring an adequate budget for the EPO, and providing a cost saving to the applicant. The distribution key, according to which 50% of the unitary patent renewal fees will be distributed to the patent offices of the 25 EU member states participating in the unitary patent enhanced co-operation, is still outstanding. The Select Committee is expected to reach a conclusion on this in Autumn 2015.
