On 23 October 2025, the European Commission published a number of delegated regulations to revise the relevant procurement thresholds which will apply to public bodies and utilities from 1 January 2026. These threshold figures are updated every two years to ensure the thresholds correspond to the thresholds set in the World Trade Organisation Government Procurement Agreement. The “light touch” thresholds under the Public Sector Directive and the Utilities Directive remain unchanged.
As you will note from the table below, several of the procurement thresholds have been revised downwards and as a consequence it is important for contracting authorities and contracting entities to be aware of the revised thresholds that are coming into force in the New Year. The changes to the procurement thresholds will impact future procurement processes and may also have an impact on modifications to existing contracts under Article 72(2) of the Public Sector Directive (Article 89(2) of the Utilities Directive and Article 43(2) of the Concessions Directive respectively).
