In this episode of "A Lo Legal En Par Minutos," Partner Edwin Cortés and Colombian criminal law attorney Tatiana Pérez analyze whether Armando's conduct in "Betty la Fea" would today fit the crime of disloyal (breach of) administration. Ms. Pérez explains that this offense was introduced by Law 1474 of 2011 (the Anti-Corruption Statute) and occurs when an administrator, partner, executive, employee or advisor, for their own benefit or that of a third party, abuses their functions and fraudulently disposes of company assets or incurs obligations in the company's name, causing economic harm to the shareholders. Although at the time the show aired this offense did not exist, today it would cover actions such as manipulating financial statements and creating "Terra Moda" to maintain control of Ecomoda. The episode also details the penalties established by law: imprisonment from four to eight years and fines ranging from 10 up to 1,000 current legal monthly minimum wages.
