The Finnish Ministry of Justice has enacted a new decree (110/2014) providing for a model form and terms and conditions for the right of withdrawal in consumer distance contracts. The model form and terms and conditions were taken verbatim from the new EU Consumer Directive (2011/83/EU), and will enter into force on 16 June 2014. Entrepreneurs engaging in distance contracts will need to provide consumers with the model withdrawal form, and will be able to use the model terms and conditions provided in the decree to satisfy the obligation to provide information stipulated in the Consumer Protection Act. The harmonization of the withdrawal right is expected to make offering cross-border distance contracts easier and more predictable for entrepreneurs, thereby promoting cross-border trade inside the EU.
