The Argentine Directorate for Consumer Protection and Consumer Arbitration established the practical scope of articles 1 and 4 of Disposition 954/2025, which prohibits requiring prior registration or additional procedures from consumers when exercising their rights of withdrawal and service cancellation. Accordingly, Disposition 3/2026 highlights the need to adopt identity-verification measures aimed at safeguarding user security and the integrity of their data, to prevent potential fraud and ensure that any request for service termination or withdrawal from the contract effectively originates from the consumer concerned.
To that end, the Disposition authorizes providers to implement consumer data and identity verification mechanisms at the time the request is processed.These mechanisms must:
- be reasonable,
- be implemented through customary means,
- have the exclusive purpose of verifying identity and protecting the user.
Within this framework, consumers must complete these prior steps for the request to be processed properly.
Finally, the Disposition clarifies that these mechanisms should not be construed as a bureaucratic obstacle, but rather as a legitimate security measure intended to prevent third parties unrelated to the contractual relationship from terminating services or reversing transactions.
