This seminar will address three current issues in respect of trade within and into Africa.  We will address the current legal regime for cross-border investment into Tanzania with particular reference to the Netherlands-Tanzania bilateral investment regime.  Our guest speaker, Claudia Santos Cruz, who will join us from Lisbon, Portugal, will talk about the recently ratified Portugal-Angola Free Trade Agreement.  We will then look at the on-going discussion relating to the development of an investor-state mechanism for the Investment Protocol forming part of the African Continental Free Trade Agreement.

The speakers for this seminar will be:

Claudia Santos Cruz, Senior Consultant at Morais Leitão (“ML”) where she assists clients on the international and cross border aspects of their investments in Portugal, Angola and Mozambique.  Ms Cruz is co-head of the Lusophone Africa practice team at ML which is dedicated to deals; transactions and advising international clients investing in these markets, with a particular focus on Angola and Mozambique.  She initially trained and practiced as an English solicitor at DLA Piper and Watson Farley & Williams in London.  Claudia is now also admitted to practice in Portugal and Mozambique as well as being recognised as a foreign expert for Angola.  Her practice focuses on the areas of investment in emerging markets: oil & gas, corporate, banking & finance and shipping related matters.

Florentine Vos, Associate at Volterra Fietta. Ms Vos is a qualified Dutch lawyer and advises and represents governments, international organisations and private clients on a wide range of contentious and non-contentious public international law and international dispute resolution issues, which has included representing the Democratic Republic of the Congo in proceedings before the International Court of Justice.  She has worked on arbitrations under the ICSID, UNCITRAL, NAI, LCIA and ICC rules, as well as domestic court litigation.

Peter Flint, Consultant at Volterra Fietta.  Mr Flint is a qualified English lawyer and advises governments and commercial parties in connection with cross-border disputes in a wide range of jurisdictions, including Russia and the CIS, the Baltic States, Turkey, Lebanon, India, Pakistan, the Middle East, South America, Thailand, Indonesia, China, South Korea and a number of sub-Saharan African States.  He has advised clients on disputes arising in the context of cross-border contracts, BITs, the ECT, multilateral trade agreements and host State investment protection legislation.  This includes significant experience in representing both investors and States at ICSID, the PCA and elsewhere.
