Session 1: Key recent and future employment law developments

This session will review the key employment law developments from the last 12 months and consider what lies ahead in 2016.  We will cover:

Pay:

  • The National Living Wage
  • Gender pay gap reporting

Working time:

  • Holiday pay - where are we?
  • Carry over of holiday for sick workers
  • Holiday entitlement when working hours change
  • is travelling time working time?

Equality law:

  • Round up of important case law developments
  • New ACAS guidance

Collective redundancies:

  • Round up of important case law developments
  • Consequences of failing to file the HR1 form

Family leave issues:

  • Extension of shared parental leave to grandparents
  • How is shared parental leave working in practice? Are employers enhancing shared parental pay?

Session 2: Disciplinary investigations - tricky issues and recent developments

This session will consider tricky issues and recent developments in the field of disciplinary investigations.  We will consider the following thorny issues:

  • Who should conduct the investigation and what is the right role for HR?
  • What is the right scope and standard of the investigation?
  • Should an employee be suspended whilst the investigation is conducted?
  • Gathering the evidence - what's needed and how to get it
  • How to approach reluctant witnesses
  • Are employees entitled to be accompanied to investigatory meetings ?
  • What should you do if the employee admits the offence?
  • What to do when faced with conflicting evidence
  • What should you do if the employee raises a grievance in the course of a disciplinary investigation?

Session 3: Effective management of the exit process - settlement agreements and termination payments

This session will explain how to navigate some of the common pitfalls that arise when negotiating settlement agreements and exit payments.  We will consider the following areas:

  • Are settlement negotiations always "off the record"?
  • Can all types of claim be settled at once?
  • Dealing with the tricky aspects of the settlement agreement
  • What to do if there is a gap between signing the agreement and termination
  • Particular considerations for financial services employers
  • The importance of getting the tax treatment right
  • The taxation of common types of termination payments
  • Proposals for reforming the taxation of termination payments

Session 4: Workplace mediation - what is it and how does it work?

For our final session we are delighted to be joined by Anna Shields, Mediator and Director of Consensio Partners.  Consensio Partners are one of the UK's leading workplace mediation specialists and trainers, supporting organisations to resolve workplace conflict.  Anna is an accredited workplace mediator who combines a deep understanding of conflict management with a commercial background.  In this session, Anna will explore  the role of workplace mediation in the modern workplace, considering the following issues:
