Ontario Superior Court allows late claims to stand in a CCAA

Court rejects extension of cause of action for breach of covenant of good faith and fair dealing to reinsurers

In a Minute Order ruling on a Federal Rule 12(b)(6) motion to dismiss a plaintiff's cause of action for breach of the covenant of good faith and fair dealing, the judge of the United States District Court located in Los Angeles (the "Court") ruled that if the California Supreme Court had to rule on this case, it would find that a cedent cannot "recover tort damages for the breach of the implied covenant of good faith and fair dealing."
