Federal Circuit rejects Medinol fraud standard

On August 31, 2009, in In re Bose Corp., No. 2008-1448 (Fed. Cir. Aug. 31, 2009), the U.S. Court of Appeals for the Federal Circuit rejected the standard of fraud applied by the Trademark Trial and Appeal Board (TTAB, or Board) since its 2003 Medinol decision.
