In September of 2011, Michigan passed the Health Insurance Claims Assessment Act1 (the “Act”), which imposes a one percent tax on, among others, certain group health plan claims paid by employer-sponsored group health plans subject to ERISA.
On August 22, 2011, the Departments of the U.S. Treasury (“Treasury”), Labor (DOL) and Health and Human Services (HHS) (collectively, the “Agencies”) jointly published proposed regulations (“Regulations”) that identify the standards for the uniform explanation of coverage requirement under the Patient Protection and Affordable Care Act of 2010 (ACA).
On August 1, 2011, the Department of Health and Human Services (HHS) issued new Guidelines on Women’s Preventive Health (the “Guidelines”).
Recently, the U.S. Departments of Treasury, Labor (DOL) and Health and Human Services (HHS) (collectively, the “Agencies”) jointly issued new interim final regulations (“New Final Regulations”) and new related technical guidance (“New Technical Guidance”) regarding the internal and external claim review requirements set forth in new Public Health Service Act Section 2719 (“Claim Review Rules”), as added by Section 1001 of the Patient Protection and Affordable Care Act of 2010 (ACA).
