Restrictions on domicile of reinsurers revised

When the Insurance Regulator overhauled the reinsurance regime in 2011, the new regulation it introduced prohibited the registration of entities whose head office was located in a tax shelter. Following changes to the tax laws, the relevant provisions now state that in order for an entity to be registered as an admitted reinsurer, its head office must be included on the Tax Authority's whitelist.

Regulator queries importance of arbitration clauses in reinsurance contracts

The insurance regulator recently lodged an objection to the inclusion of arbitration clauses in reinsurance contracts, arguing that such clauses provide that the parties to a contract waive in advance the right to file an appeal against the arbitration award before a judicial court. According to the regulator, the arbitration process should be simply another step before litigation.
