The New Zealand Commerce Commission (NZCC) is consulting on new draft guidelines that outline their approach to assessing clearance and authorisation applications. The revised Mergers and Acquisitions Guidelines, which were last published in 2003, have been updated with new national and international case and best practice developments, as well as the NZCC's plain English standard. The NZCC is also consulting on the newly drafted Authorisation Guidelines to replace the Benefit and Detriment Guidelines, last published in 1997. The Authorisation Guidelines will outline the NZCC's approach and process when considering applications for authorisations for mergers and agreements. Submissions on both sets of draft guidelines are due by 5pm on 9 April 2013. Click here for further details.
