Public consultation in the framework of the decision-making process on the allocation of the 3600 – 3800 MHz frequency band

On December 11, 2012, the Italian National Communication Regulatory Authority (hereinafter the “Agcom”), published on its website the Resolution no. 553/12/CONS, which has launched the “Public consultation on the use of the 3600-3800 MHz frequency band for terrestrial systems capable of providing electronic communications services”, under the EU Decision no 2008/411/EC and Decision no. 243/2012/EU.

Furthermore, under the international studies and the survey of CEPT, which point that the interest in the band 3600-3800 MHz has changed over time, due to the fact that those frequencies can be used by the new technologies, including any systems of third generation mobile (IMT2000/UMTS), LTE, WiMAX, IMT in general, or any other equivalent and compatible technologies, Agcom has launched the public consultation in order to verify the actual market demand for the application of 3600 – 3800 MHz frequency band, as well as the conditions of use taking account of the technological developments and in the evolution of technical conditions and regulations.

In this context, in fact, the band in question could therefore be an important resource for the creation and development of networks, wireless broadband and ultra-broadband, so as to assist and support the introduction of next-generation technologies.

The modalities of participation and the text of the public consultation are listed in Annexes A and B of the said resolution.

The responses to the public consultation should be sent by the deadline of 60 days from the date of publication of the decision on the website of the Agcom.
