Court finds for complainant on misleading PPI sale: The court has dismissed an appeal by Central Capital Limited (CCL). CCL had made a loan to a married couple. The monthly repayments quoted included the amount to cover an additional loan for the purchase of Payment Protection Insurance (PPI) on the loan. However, this was not explained in a clear manner in the telephone call during which the loan was agreed. Although the subsequent paperwork made the amounts attributable to the PPI clear, the court found, and the Court of Appeal agreed, that the manner of the original description was not fair or clear and was misleading and as a result CCL had breached the (then) Financial Services Authority's Insurance Conduct of Business rules.
