On 22 October 2008, following extensive analysis of the newspaper and magazine distribution sector, the Office of Fair Trading (OFT) published the results of its work. This comprises three separate measures. Firstly, an OFT legal Opinion, providing guidance to newspaper publishers and wholesalers designed to facilitate self-assessment of distribution arrangements (this is the first ever Opinion created by the OFT). Secondly, a review of the National Newspapers Code of Practice, which recommended that the Code should be repealed. The Secretary of State has opened a consultation on repealing the Code, based on the OFT's recommendation. Finally, a draft decision, which is now subject to consultation, in which the OFT proposed not to refer the newspaper and magazine distribution sector at this time to the Competition Commission for a Market Investigation
