• DOS's monthly Visa Bulletin for October 2010 indicates small progress with regard to immigrant visa number availability for nationals of the majority of countries falling under the Third Employment-Based immigrant category ("EB-3") reserved for individuals with college degrees. Importantly, the new Visa Bulletin indicates immigrant visa number availability for nationals of Mexico in the EB-3 category. However, only those Mexican nationals with permanent immigration priority dates of April 22, 2001 or prior are eligible to move forward with Adjustment of Status proceedings.
  • Visa validity period for citizens of P.R. China has been recently increased for H-1B visa applicants. Chinese nationals may now be issued one year validity visas, which is a significant step forward when compared to the prior reciprocity-based visa validity maximum of three months.
