The new Bribery Act 2010 also survived in the parliamentary wash-up process. This creates offences of:

  • bribing another person;
  • being bribed;
  • bribing foreign public officials; and
  • failure of commercial organisations to prevent bribery.

The maximum penalty for the offences is 10 years' imprisonment and/or an unlimited fine. The Act will not take effect until the Secretary of State makes a commencement order.
