This is to remind you of the required annual notice to the Centers for Medicare and Medicaid Services (CMS).
WHO IS SUBJECT TO THE NOTICE REQUIREMENT?
The annual notice requirement applies to you if your organization offers prescription drug coverage to employees who are Medicare Part D eligible individuals (including retirees and dependents). This notice is required whether the prescription drug coverage is primary or secondary to Medicare and the notice must state whether your prescription drug coverage is creditable. Remember, “creditable coverage” means that your prescription coverage is at least as good as the coverage provided by Medicare (if you are not sure if your coverage is creditable, please ask your prescription drug vendor or your plan’s actuary).
WHAT IS THE DEADLINE TO FILE THE NOTICE?
You could have already fi led this notice once before. In 2006, the deadline for fi ling the notice was March 31. For plan years that end in 2007 and beyond, the notice to CMS must be provided within 60 days after the beginning of the plan year. This means that if you have a calendar plan year you must fi le the notice by March 1, 2007.

Additionally, under the title “Guidance Documents,” you will fi nd a link to the “Disclosure to CMS Guidance” that provides instructions for completing the form. http://www.cms.hhs.gov/CreditableCoverage/ We also would like to remind you that in addition to the annual notice, a similar notice must be fi led:
- Within 30 days after termination of a prescription drug plan; and
- Within 30 days after any change in the creditable coverage status of a prescription drug plan.
