The Italian Communications Authority published two decisions (No. 51/13/CSP and 52/13/CSP, both dated May 3, 2013) to implement certain provisions of the Italian Media Code (Legislative Decree No. 177 dated July 31, 2005). Indeed the Italian Media Code prohibits all television programs which may seriously harm the physical, mental and moral development of minors. On-demand audiovisual media service providers may make available the prohibited content mentioned above, provided that they use measures to prevent access to minors. The two decisions of the Authority, only recently published on the Authority’s website, establish the criteria to identify the prohibited content and the relevant technical measures to protect minors.
