In this case a mother was seeking a declaration allowing her 21 year old daughter who had “significant learning difficulties” to be sterilised.

At the time the application was made to the Court of Protection, the daughter had one child and was expecting her second. Her mother was seeking to argue that it would be in her daughter’s best interests for the procedure to take place after the birth of the second child.

The mother has now withdrawn her application. Unusually the case was being heard in public because it raised issues of “considerable” importance. However, reporting restrictions have meant that no details about the woman’s identify, the NHS trust or local authority can be disclosed.
