In 2016, 13,107 reexamination petitions were received, 17,623 cases were concluded; and 3,969 requests for invalidation were received, 4,100 cases were concluded (up 12% year on year).
In 2016, the average pendency for reexamination is 11.9 months, down by 1.8 months; the average pendency for invalidation is 5.1 months on average, down by 0.7 months.
From Jan. 2016 to Nov. 2016, 1,733 invalidation cases were subject to short-term examination by the Patent Reexamination Board, accounting for 57% of the total invalidation cases. The average pendency for short-term invalidation cases is 3.9 months, obviously shortened than previous year. Specifically the pendency from oral hearing to issuance of decision was obviously shortened, making the overall cycle of the invalidation cases from 5.8 months in 2015 reduce to 5.1 months by the end of 2016.
