The European Commission has referred Spain to the European Court of Justice (ECJ) for failing to comply with a previous Court ruling requiring Spain to recover illegal State aid from household appliances group, Magefesa. In 1989, the Commission ordered Spain to recover the aid. Its decision was confirmed by the ECJ in 2002. Eight years later, the Commission claims that although aid was recovered from some of Magefesa’s subsidiaries there are still sums outstanding from other subsidiaries. On 30 September 2010, the Commission took an action requesting the ECJ to impose a daily penalty of €131,136 from the date of the 2002 ruling until compliance and a lump sum of €14,343 per day from the 2002 ECJ ruling until the date of the ECJ’s final Judgment.
