On September 28th, the Third Circuit reinstated cases claiming that defendant banks violated the Electronic Fund Transfers Act by failing to place on their ATM machines and on the ATM screens, notices telling customers of possible transaction fees. The trial court failed to explain how the FDIC handbook upon which the banks and the trial court relied for a good faith defense fits within the statutory scheme. Additionally, whether the banks acted in good faith is a question of fact. Dragotta v. West View Savings Bank (Not Precedential).
