In one of its final significant enforcement actions prior to handing over power, the FSA issued a Final Notice imposing penalties of £14 million on Prudential plc for failure to disclose appropriate information to the FSA (Principle 11) and £16 million on The Prudential Assurance Company Limited (PAC) for failure to deal with the UK Listing Authority in an open and transparent manner (Listing Principle 6). The conduct centered on a failure to disclose to the FSA an intended acquisition prior to the leaking of information about the intended acquisition to the media. In a related Final Notice, the FSA censured Mr Cheick Tidjane Thiam (Prudential Group, Group CEO of PAC) for being knowingly concerned in PAC’s breach of Principle 11.
