In Silverpop Systems, Inc., v. Leading Market Technologies, Inc., the U.S. District Court for the Northern District of Georgia has dismissed a lawsuit against an Internet marketing company by one of its customers accusing it of lax data security practices following a data breach. The court held that the customer had failed to establish an applicable data security standard of care, and that its negligence claim was also barred by the economic loss doctrine. The court also ruled that the contract between the companies did not provide a basis for recovery.
