Recently, we issued an Alert entitled “Updates Regarding Federal and State Continuation Coverage” (SRZ Alert, Dec. 28, 2009), available here, in which we reported that the Department of Labor (the “DOL”) would soon issue model notices for communicating the recent extension of the Federal COBRA subsidy. There are three different notices available from the DOL.
The first is the Updated General Notice, which must be supplied to all qualified beneficiaries (not just covered employees) who have (1) experienced a qualifying event (regardless of the qualifying event) between September 1, 2009 and February 28, 2010, and (2) have not yet been provided an election notice.
The second notice is the Premium Assistance Extension Notice, which must be provided to individuals who have received an election notice, but have not received information regarding the subsidy extension.
Finally, New York State insurers must send the third type of notice, entitled the Updated Alternative Notice, to persons eligible for state-law continuation coverage.
