Existing law prohibits employment discrimination on the basis of "sex." As stated under current law, the definition of "sex" includes pregnancy, childbirth and related medical conditions. Assembly Bill 2386 amends the FEHA, Government Code §12926(q), to clarify that the definition "sex" also includes breastfeeding and related medical conditions. This amendment is declaratory of existing law. Therefore, it is effective immediately and applies retroactively.
