On 4 June 2013, the FCA published a policy statement on tracing employer's liability (EL) insurers. This synopsises the responses received by the FCA's predecessor to its July 2012 consultation paper; and sets out the new rules which will apply in this regard. These include clarification as to (a) the required response time to a search request received, (b) the parties who can make a search request and (c) the fact that confirming cover does not automatically mean confirming liability for a potential claim. The new rules apply to UK-authorised firms, EEA firms passporting into the UK and managing agents. Firms must implement the rules no later than 4 December 2013.
