In Community Dental Centres v Sultan-Darmon the EAT allowed an appeal from the employment tribunal and decided that a dentist was neither an 'employee' nor a 'worker' at the Centre where he provided dental services.
His contact described him as a 'self-employed independent contractor dentist'.
Point to note –
- The legal distinction between 'employee' and 'worker' is very narrow in practicet. The important legal distinction is between an employee and a self-employed contractor. Employers should always be clear as to the legal status of any individual doing work for them.
