The UK Family Court brushed aside the corporate veils of companies used by a husband to hold a portfolio of UK properties using resulting trust to treat the underlying properties as the husband’s assets. This is the same route used by the Supreme Court in its well-known Prest decision. M v M & 5 Others [2013] EWHC 2534 (Fam) will be of particular interest for its explanation of how the wife proved the existence of a resulting trust. More detail will follow in a later post.
