In a recent no-action letter requested by the Investment Company Institute (ICI), the SEC Staff stated that it would not recommend enforcement action against an investment adviser that treats a 529 plan trust as a “pooled investment vehicle” for purposes of Rule 206(4)-2 under the Investment Advisers Act (sometimes referred to as the “Custody Rule”).
