On 16 November 2012 the Federal Network Agency (Bundesnetzagentur) decided in a preliminary decision with effect from 1 December 2012 that the rates which the four German mobile network operators Telekom Deutschland GmbH, Vodafone D2 GmbH, E-Plus Mobilfunk GmbH & Co. KG and Telefónica Germany GmbH & Co. OHG are entitled to charge for termination to their own mobile telecommunications network are 1.85 ct/min until 30 November 2013 and 1.79 ct/min as of 1 December 2013 until 30 November 2014 (mobile termination rates). To date, the four mobile network operators charged more or less the same rates varying from 3.36 ct/min to 3.39 ct/min for their call termination services. According to the statements by the Federal Network Agency the mobile termination rates have been calculated on the basis of the costs of an efficient reference network operator meeting 25 per cent of overall demand for speech, SMS and data conveyance in Germany. The preliminary decision of the Federal Network Agency is currently reviewed by the European Commission which will comment on it.
