Tsar & Tsai successfully defended Burberry Limited’s “Burberry Check” trademark.  The Taipei District Court recognized that the classic patterns of the “Burberry Check” mark are a famous brand trademark familiar to consumers.  The defendant’s use of the same or similar check patterns on clothing constituted unfair competitive conduct infringing upon the trademark of others, and was an infringement of the trademark.  The defendant was required to compensate Burberry for damages from trademark infringement and loss of goodwill, and to publicize the judgment in newspapers.
