On December 10, 2007, Senator Patrick Leahy, Chair of the Senate Judiciary Committee, introduced S.2450, to amend the Federal Rules of Evidence and add new Rule 502. This legislation addresses waiver of the attorney-client privilege and work product. It is identical to proposed Rule 502, approved by the Judicial Conference and transmitted to Congress in September 2007. The amendment was discussed in an earlier post here.
