In Keith Halliday (Valuation Officer) v Waltham Abbey Gunpowder Mills Charitable Foundation Ltd - Lawtel 15.1.08 the applicant sought an order for costs in respect of his appeal against the respondent although he had been dilatory in the preparation of his appeal: in obtaining counsel's advice; in disclosing documents and generally in progressing the matter, which ultimately settled for a much lower figure than the applicant had sought on appeal. It was held that in such a case it was wholly inappropriate to make an award of costs against the respondent.
