The Defend Trade Secrets Act (DTSA) was signed into law by President Obama on May 12, 2016. Employers now have an affirmative duty to notify employees of the new whistleblower immunities contained in the DTSA in “any contract or agreement with employee that governs the use of a trade secret or other confidential information.” To ensure that your company is entitled to the maximum benefits of the DTSA, you might want to consider incorporating the immunity notice directly into employment agreements and policies in the near term.
