RICS has published the second edition of its Code of Practice on Service Charges in Commercial Property.
To coincide with publication of the new code, the City of London Law Society has published some model service charge clauses - one set for an office building, and one set for a shopping centre. The code and the model clauses can be found here: www.rics.org and here: www.citysolicitors.org.uk
The model service charge provisions are intended to balance the interests of the landlord and the tenant and to reflect many aspects of the code. They include provisions dealing with the CRC Energy Efficiency Scheme, although there is an acknowledgment that there is not as yet any industry consensus on how to deal with CRC. The CRC provisions may be revisited as the industry's thinking on CRC develops.
