The European Commission (Commission) has extended the rules for providing aid for film and audiovisual projects. A Commission communication establishing criteria for evaluating the compatibility of such schemes was adopted in 2001 and the relevant criteria were due to expire on 31 December 2009. However, the Commission has decided to extend the application of the criteria under the Communication until 31 December 2012. Essentially, the criteria are that the aid must benefit a cultural product, the producer must be free to spend at least 20% of the production budget in other Member States, the level of subsidy must be no more than 50% of production costs (other than very difficult and low budget films) and aid supplements for specific film making activities is not permitted.
