On February 16th, the U.S. District Court for Maine dismissed most of a putative class action lawsuit stemming from allegedly improper home foreclosures. To the extent false affidavits were used to support foreclosure, the proper remedy is to vacate that foreclosure, not to institute a separate lawsuit, the Court held.
