The TIPO Published the Ranking of Patent Applicants for Filings in 2016
According to the patent statistics released by Taiwan Intellectual Property office (“TIPO”), the top three applicants in respect of the number of patent applications filed in 2016 are: (A) as for domestic applicant: Taiwan Semiconductor Manufacturing Company Limited (873), Industrial Technology Research Institute (468), and Hon Hai Precision Industry Company Limited (400); and (B) as for foreign applicants: Intel Corporation (U.S.A.) TIPO Published Trends Q4 2016: Patent Statistics for Filing
According to the statistics released by TIPO, 19,827 patent applications were filed in the 4th quarter of 2016, down 1.71 % from the same quarter of 2015, of which 12,365 (-0.20%) were for invention patent, 5,189 (-8.68%) were for utility model patent, and 2,273 were for design patent (+8.29% ).
Among the applications for invention patent, 5,353 (+2.98%) were filed by domestic applicants and 7,012 (-2.50%) were filed by foreign applicants. The top five nationalities of invention patent applicants in 2016 were Japan (2,920), U.S.A. (1,829), China (491), South Korea (463) and Germany (345). The top five domestic corporations filing invention patent applications in 2016 were Taiwan Semiconductor Manufacturing Company Limited (600), Industrial Technology Research Institute (293), Inventec Corporation (193), Metal Industries Research & Development Centre (119), and Hon Hai Precision Industry Co., Ltd (93). The top five foreign corporations filing invention patent applications were Intel Corporation (310), Semiconductor Energy Laboratory Co., Ltd (147), Qualcomm Incorporated (131), Applied Materials, Inc. TIPO announced the statistics of Patent Prosecution Highway (PPH) during the period from January through March of 2017
According to TIPO, there were 133 patent applications made under the Taiwan-U.S. PPH in the 1st quarter of 2017. There were 121 applications made under the Taiwan-Japan PPH in the 1st quarter of 2017. No application was made under the Taiwan-Spain PPH in the 1st quarter. The TIPO announced statistics for the Accelerated Examination Program (AEP) during the period from January to March 2017
In the 1st quarter of 2017, there were 87 patent applications taking advantage of the accelerated examination program (AEP), of which 39 were filed by domestic applicants and 48 were filed by foreign applicants. The top four nationalities of foreign applicants were: Japan (15); U.S.A. (10); Germany (6); and U.K. (4). There were 64 applications filed under Category 1 (i.e., the corresponding application has been approved by a foreign patent authority after substantive examination), and the first office action in those matters (including examination opinions and final decisions) was issued in an average of 71.7 days. There were 15 applications filed under Category 3 (i.e., the invention application is essential to commercial exploitation), and the first office action was issued in an average of 134.3 days. There were 8 applications filed under Category 4 (i.e., inventions related to green technologies), and the first office action was issued in an average of 98.6 days. (Charles Ma, Patent Department)
The TIPO Statistics Report: Patent Applications in 2016
In 2016, 72,442 patent applications were filed with the TIPO, of which, in terms of category, 43,836 applications (down 1% from 2015) were for invention patents, 20,161 (-6%) were for utility model patents, and 8,445 (+8%) were for design patents. Of the 2016 applications, 40,443 applications were filed by domestic applicants and 31,999 applications were filed by foreign applicants. Japan continued to top the list of applicant nationalities (13,349 applications), followed by the U.S.A. (7,972), and China (2,202). TIPO 2016 Trends – Trademark Statistics
TIPO received a total of 79,300 trademark applications in 2016, an up approximately 1% from the previous year. Among the applications, 57,548 (a slight increase from 2015) were filed by the domestic applicants, and 21,752 (also a slight increase from 2015) were filed by foreign applicants. In terms of the nationalities of applicants, China ranked first (4,281), followed by the U.S.A. (3,753) and Japan (3,669). In addition, by the end of 2016, the amount of the applications to be examined has declined to less than 50,000. (Jay You, Trademark Department).
Intellectual Property Court ruled that Ferrero S.P.A.’s “KINDER SCHOKO-BONS” mark is well-known among related consumers and that the opposed mark “Chocobons” may cause likelihood of confusion and shall not be granted for trademark registration
Intellectual Property Court ruled in its administrative judgment dated November 7, 2016 that the registered mark “KINDER SCHOKO-BONS” owned by Ferrero S.P.A. has been well-known among related consumers before the opposed mark “Chocobons” was filed for the trademark application. The opposed mark “Chocobons” is similar to the “KINDER SCHOKO-BONS” mark and the degree of similarity is not low. The designated goods of both marks are identical and/or similar.
