There has been an increase in the numbers of employers offering flexible working arrangements to employees but what does this mean for sponsored workers?

UK Visas & Immigration (UKVI) has confirmed that there are no rules to prevent migrants from working from home. If, however, the migrant is not required to be in the office, the question will be asked if the migrant needs to be in the UK at all.

Before a Tier 2 migrant is therefore offered the option of working from home, the sponsor will need to assess the reasons why the individual needs to be in the UK.

If the migrant is required to be in the UK, eg to visit client sites, then it should be possible for the migrant to work from home. It is also important to remember that a change in work location must be reported to UKVI via the Sponsor Management System (SMS) within 10 working days.
