On December 8, 2014, the U.S. International Trade Commission ("Commission") issued a press release announcing their vote to institute an investigation of Certain Three-Dimensional Cinema Systems and Components Thereof (Inv. No. 337-TA-939).
The investigation is based on a November 7, 2014 complaint filed by RealD Inc. of Beverly Hills, California alleging violation of Section 337 in the importation into the U.S. and sale of certain three-dimensional cinema systems and components thereof that infringe one or more claims of U.S. Patent Nos. 7,905,602; 8,220,934 ; 7,857,455; and 7,959,296. According to the Notice of Investigation, the Commission has identified MasterImage 3D, Inc. of Sherman Oaks, California and MasterImage 3D Asia, LLC of South Korea as the respondents in this matter. The Notice of Investigation further indicates that the Office of Unfair Import Investigations will not participate in this investigation.
Lastly, Chief ALJ Bullock issued a notice indicating that Theodore R. Essex will be the presiding Administrative Law Judge in this matter.
