The Competition Commission (CC) has launched a review of its current guidelines on how merger references from the Office of Fair Trading to the CC under the Enterprise Act 2002 are dealt with. The current guidelines have been in force for over four years and whilst the CC indicates that no fundamental shortcomings were reported, it considers a regular review to be appropriate. Areas such as the treatment of vertical mergers will be expanded, whilst the section on remedies will be shortened due to the fact that separate merger remedies guidelines are in the process of being drafted. The CC intends to issue the final version of the revised guidelines by the end of 2008, with the release of a draft version in the summer for consultation. A draft of the merger remedies guidelines will be issued for formal consultation in April/May 2008.
