David Jones and Myer allow a number of merchandise and service suppliers to operate independent businesses within its stores. Such businesses are sometimes known as concessions or licensee businesses.
On 20 February 2014, the ACCC granted authorisation (immunity under the Act) to Myer for five years until 14 March 2019, enabling it to invite businesses operating within Myer stores or online to participate in certain promotions, including discount promotions, loyalty programs, Myer Card promotions and other promotions relevant to businesses operating within Myer stores and online.
On 27 February 2014, the ACCC also issued a draft determination proposing to grant authorisation to David Jones to continue inviting certain licensee business operating within its stores to participate in storewide and category wide promotions.
The ACCC considered that the arrangements are likely to result in public benefit in the form of enhanced competition including reduced prices for consumers and through the simplification of Myer and David Jones’ promotions.
