R (on the application of Bradley and others) v Secretary of State for Work and Pensions

The Court of Appeal has agreed with the High Court decision that the government should abide by some of the Parliamentary Ombudsman’s findings that the government was guilty of maladministration to members of defined benefit pension schemes.

The government had initially rejected the Parliamentary Ombudsman’s finding that the government had provided misleading information to the members of final salary pension schemes about the security of their pension entitlements. In particular the Ombudsman decided that the government should have highlighted the risk of not recovering pensions on the insolvency of the employer.
