One of Lord Jackson's recommendations, as set out in his Review of Civil Litigation Costs (Final Report), has now been implemented. Lord Jackson recommended that, in clinical negligence cases, the NHSLA, MDU, MPS and other similar bodies should nominate an experienced officer to whom, after the event, claimants' solicitors could report flagrant cases of defendant lawyers failing to address issues.

Part of the rationale behind this recommendation was to encourage settlement where possible. The NHSLA, MDU and MPS have now nominated experienced and senior officers to receive such reports. The impact of these appointments will, no doubt, be assessed over the coming months but anything that facilitates the speedy resolution of valid claims is to be welcomed.
