On May 3, 2019, the Saskatchewan Court of Appeal released its decision in the Saskatchewan government’s reference regarding the constitutionality of the federal government’s carbon tax. In a 3-2 decision, the Court ruled that the federal carbon tax “backstop” is indeed constitutional.

Saskatchewan’s Premier Scott Moe has stated that the decision will be appealed to the Supreme Court of Canada. The governments of Ontario and Manitoba have stated that they will be launching their own court challenges to the carbon tax, while Alberta and New Brunswick expressed their disagreement with the decision.
