FSA has published an undertaking by the On-Line Partnership Limited. It objected to a term in the firm's document "ABOUT US: Our Fees, Services and Client Agreement" that said "I confirm that I have received, read and understood this agreement and agree to the terms set out within". OFT's September 2008 guidance says terms of this nature "effectively require consumers to say these conditions have been met, whether they have or not". The firm has agreed to change the term to explain the client should read the terms and ask if they do not understand anything as the firm intends to rely on the agreement.
