• The Australian Energy Market Commission (AEMC) assumed rule making responsibility for the National Energy Retail Rules which commenced on 1 July 2012.  The Rules also require the Australian Energy Regulator (AER) to develop and operate an energy price comparison website.  Energy Made Easy was launched on 1 July.
  • The AEMC published a supplementary submission to the Transmission Frameworks Review provided by Grid Australia and Clean Energy Council.  The Grid Australia paper, prepared by PricewaterhouseCoopers, discusses the application of different forms of economic regulation to transmission services. Clean Energy Council submitted its paper in response to this.
  • The AEMC published an issues paper on advice that it has been asked to provide to the Standing Council on Energy and Resources in relation to the resilience of the financial relationships and markets that underpin the operation of the NEM.  In particular, the AEMC has been asked to provide advice on any risks to the efficient functioning of the NEM arising from financial interdependencies between market participants as a result of their exposure to a common spot price and their hedging arrangements
  • The AEMC called for public submissions on the draft report published under the review of electricity distribution reliability outcomes and standards.  The draft report is the first time that tradeoffs between cost and reliability have been looked at publicly in Australia and the first time NSW customers have been surveyed about the value they place on a reliable supply of electricity.  The draft report says that cost savings of up to $2.5 billion over 15 years are possible if the level of distribution reliability is reduced in NSW – with limited impact on outages for customers.
  • The AER published a report summarising the AER's compliance monitoring and enforcement activities in the wholesale electricity and gas markets during the April-June 2012 period.  It provides an overview of the results of investigations (including special reports into significant market or power system events), compliance audits, targeted compliance reviews and rebidding inquiries undertaken during the quarter.
  • The AER published the regulatory proposal for Murraylink – the interconnector that links the South Australian and Victorian regions in the NEM – for the ten year period ending 30 June 2023.
  • In Application by Alinta Sales Pty Ltd (No 2) [2012] ACompT 13, the Australian Competition Tribunal affirmed the decision of the Economic Regulation Authority of Western Australia (ERA) made on 28 April 2011 and titled the Economic Regulation Authority’s revised access arrangement for the WA Gas Networks Pty Ltd Mid-West and South-West Gas Distribution Systems.
