Mexico’s Energy Reform
Amendments to the Organic Law of
the Federal Public Administration.
On August 11, 2014 it was published in the Federal Official
Gazette the Decree whereby several provisions of the Organic
Law of the Federal Public Administration ("OLFPA") were
amended. Consequently, such amendments will be in force as
of August 12, 2014.
What are the amendments?
The OLFPA has included within its structure coordinated energy
regulatory agencies, which are the Energy Regulatory
Commission (CRE) and the Hydrocarbons National Commission
(CNH) with legal authority as well as technical and
The Ministry of Energy (SENER) is given a mandate to
establish, conduct and coordinate the national energy policy and
supervise its compliance. It will be entrusted, among other
things, with granting and revoking assignments and agreements
for the exploration and exploitation of hydrocarbons.
One of the additional functions of the Ministry of Environment
and Natural Resources (SEMARNAT), is that it will have to
provide the necessary coordination and collaboration
mechanisms with the National Agency for the Industrial Safety
and Environmental Protection of the Hydrocarbons Sector (a deconcentrated

The Ministry of Economy will have the authority to provide,
along with SENER, the national policy promoting purchases
from national suppliers in the hydrocarbon and power sectors.
The amendments to the OLFPA add new authorities and
obligations to SENER to conduct the national energy policy, as
well as to lead the coordination between the coordinated energy regulatory agencies (CRE and CNH) and the other State Ministries involved in the development of the energy industry in Mexico.
